Café failed to pay chef thousands in wages

A CHEF has been awarded more than £5,000 in unpaid wages and holiday pay after taking his former employer to a tribunal.

Nuno Ricardo Cruz said he was forced to resign from his job in July last year after he was not paid for the hours he worked the previous month.

LM Pinto Limited, which operates Sip N’ Snack Café, had not paid Mr Cruz his June wages because there had been a dispute over the amount of hours worked, the tribunal was told in a hearing at the start of this month.

Having heard the facts of the case, the Employment and Discrimination Tribunal chair, Hannah Westmacott noted that “failing to pay wages for over two weeks constitutes a fundamental breach of contract” and ordered LM Pinto Limited to pay £5,544 in unpaid wages and holiday pay.

The respondent did not take part in the hearing, with the tribunal noting that there had been no participation since a previous request for adjournment had been denied.
