Miri man gets 5 months’ jail for drug abuse
by Jacqueline Raphael · Borneo Post OnlineMIRI (Nov 27): The Magistrates’ Court here today sentenced a drug abuser to five months in jail.
Magistrate Sandy Yvette Freddy convicted Danien Elia on his own guilty plea to a charge under Section 15 (1) (a) of the Dangerous Drugs Act (DDA) 1952, which is punishable under Section 15 (1) of the same Act.
The Section provides for a fine of up to RM5,000, or up to two years in jail, and supervision under Section 2 of the Drug Dependants (Treatment and Rehabilitation) Act 1983 for between two and three years in accordance with Section 38B of the DDA 1952 upon conviction.
Danien, 32, of Jalan Sibu, Taman Tunku was also ordered to undergo police supervision for a period of two years.
Based on the facts of the case, Danien was found to have used dangerous drugs such as methamphetamine and amphetamine, which are listed in the First Schedule of DDA 1952 (Act 234), by inserting the drugs into his body without the permission of the authorities.
He was charged with committing the offence at 10.35am on April 18 this year at the Miri District Narcotics Criminal Investigation Division office.
Insp Mudzilawati Abdul Rahman appeared for the prosecution while Danien was unrepresented by legal counsel.
