Ogden man sentenced to 5 years to life in prison for sexual activity with minor
by Tim Vandenack ksl · KSL.comOGDEN — An Ogden man faces up to life in prison for sexual misconduct with a minor several years ago.
Second District Court Judge Catherine Conklin sentenced David Jonathan Phillips, 44, to five years to life on one count of forcible sodomy, a first-degree felony. As part of a plea deal, two other charges were dismissed: one count of aggravated kidnapping, a first-degree felony, and one count of sexual exploitation of a minor, a second-degree felony.
According to his plea agreement, Phillips engaged in a sexual relationship for around a year between 2018 and 2019 with a boy who was 14-15 years old at the time and Phillips was 35-36 years old.
The two met via a social media app and Phillips, who was living in Clearfield, would pick up the boy at his Roy home and take him to Clearfield, where they engaged in sexual activity on numerous occasions. Authorities say photographs, text messages and statements corroborate the happenings.
"David would use coercive means to continue his sexual abuse of (the boy), including physical acts of violence and threats of suicide if (the boy) attempted to leave or end the relationship," the plea deal states.
Phillips was granted credit for the 145 days already served in prison.
