Nagaland to transfer administrative control of 211 District Court employees to GHC

DIMAPUR, OCTOBER 2: The Government of Nagaland is in the process of transferring the administrative control of 211 District Court employees under the control of the Gauhati High Court.

As per Court documents, the case relates to separation of judiciary from executive in the State of Nagaland. This is also in line with action taken in all other States of North East, where District Court employees have been brought under the administrative control of the High Court.

In a hearing of civil original petition (contempt) before Chief Justice Vijay Bishnoi and Justice Manish Choudhury, Advocate General Nagaland, KN Balgopal submitted that the State Government has already issued notification in respect of transferring the administrative control of the 211 District Court employees under the control of the Gauhati High Court and that further modalities in this regard would be finalized in deliberation with the administrative wing of the Gauhati High Court within the next few days.

After hearing the Counsel appearing for the parties and after taking into consideration the assurance given by the Advocate General, Nagaland, the Court was of the view that the orders passed by the Court in WP(C) No. 192/2018 and WP(C) No. 217/2019 have substantially been complied with.

However, the Court observed that the issue that has remained for consideration is in respect of the District Court employees who have retired on completion of 35 years in contravention of the retirement age as prescribed in Nagaland District Employees Service Rules, 2017.

On this, the Advocate General Nagaland submitted that this issue shall also be taken up for consideration during deliberation with the High Court authorities and an attempt will be made to fix the modalities in respect of these employees.

In view of the submissions made by the AG Nagaland, the Court listed the matter to be heard on December 12 next.
