Disturbing New Details Have Emerged in the Case of KJ Biermann, Son of ‘Real Housewives of Atlanta’ Alumna Kim Zolciak

“This would now mark the second time he has been charged with an offense of a sexual nature of a very serious kind which involves female victims.” That’s Deputy District Attorney Caitlin McGillicuddy, describing the case against Kim Zolciak’s 15-year-old son, Kroy “KJ” Biermann Jr. — and the word “second” is what changed this story’s entire shape.
KJ was arrested in August after a classmate accused him of sexually assaulting her in April, allegedly in the changing area of a Georgia gym. In September, a Fulton County grand jury indicted him on seven felony counts tied to that incident, including aggravated sodomy and aggravated sexual battery. What came out during his bond hearing made it worse: KJ was already under court supervision for a prior sexual offense when the April incident allegedly occurred.
Before the gym incident, KJ had already been charged — in October 2025 — with sexual battery of a victim under 16, tied to videos investigators say they found on his phone allegedly showing sexual contact with a young relative reportedly under age 12. McGillicuddy said those videos allegedly showed penetrative sex along with “predatory, derogatory” language directed at the relative. Because KJ was a minor, that case was handled in confidential juvenile court, which is why none of it was public until prosecutors raised it at his current bond hearing. He was placed under court supervision as a result, a status that runs through 2027.

KJ’s attorney, Jason Sheffield, disputed how prosecutors characterized that earlier case, saying their description “grossly misrepresent[s] both the facts and the ultimate resolution of that case.” He called the underlying conduct “horseplay” and “boundary crossing” rather than criminal — while acknowledging he hadn’t actually seen the videos he was describing. Sheffield has separately called the current, April-related allegations false, citing a passed polygraph and the absence of male DNA evidence.
Despite the second, more serious allegation now on record, Judge Melynee Leftridge granted KJ bond at $200,000. His release conditions require him to live at his mother’s home, attend school virtually, stay off cellphones and social media, and have no contact with anyone age 16 or younger. His defense is now seeking to move the April charges into Georgia’s juvenile justice system, which would limit his exposure compared to being tried as an adult. For now, the core discrepancy remains unresolved in public view: prosecutors describing video evidence of penetrative sexual contact with a child under 12, and a defense attorney — by his own admission, without having watched that evidence — calling it horseplay.
