A Judge Granted Olivier Martinez a Temporary Restraining Order Against Halle Berry and Cut Her 50/50 Custody of Their 12-Year-Old Son to Daytime Visits

Halle Berry‘s court-ordered time with her 12-year-old son, Maceo, is now limited to daytime visits after a Los Angeles judge partly granted her ex Olivier Martinez’s request for a temporary restraining order on Thursday, Oct. 1, 2026. People, citing the order, reports visits on Mondays, Tuesdays, Saturdays and Sundays from 10 a.m. to 8 p.m., with partial custody continuing “to maintain communication.” Page Six describes the schedule differently: 2 days a week and every other weekend.
Berry must stay 100 yards from Martinez, but the judge denied a request for sobriety monitoring, citing “insufficient information.” The next hearing is Oct. 16; Maceo turns 13 on Oct. 5. The order is temporary, and the differing accounts of the visit schedule leave its precise terms unclear.
Martinez’s filing describes an alleged confrontation at Berry’s house on Sept. 26. He says Maceo was wearing VR goggles in his room around 8:30 p.m. when Berry came in and began pushing him, apparently as a joke. Maceo said, “Stop. Let me finish the game first.” Martinez alleges that this “sent her into a rage”: she called Maceo “so stupid” and “such an idiot,” grabbed his neck, choked him and shouted, “Who is dominant now?! Who is dominant?!”
According to Martinez, Maceo “had to fight back,” escaped and screamed, prompting Berry’s fiancé, Van Hunt, to enter the room. Martinez says Maceo phoned him in a panic, saying “come pick [me] up right now” during a 27-second call, then texted, “Are u here please come.” When Martinez arrived, he alleges, Maceo came out of the house, followed by Hunt carrying bags of the boy’s clothing with “a shocked look on his face.”
The filing also includes a text Berry allegedly sent the next morning: “I feel terrible about what happened last night as I know he does as well”; earlier texts say, “No I’m not ok with it. He wants to fight his mother?? What kind of kid are we raising” and “I’m just money bags! This is wrong and wrong!” Martinez further alleges that over the past 1.5 years, Berry used MMA-trained chokeholds while wrestling Maceo to the ground and making him “tap out,” conduct he says she characterized as joking.

In a separate claim about a 2023 child-support dispute, Martinez alleges Berry told Maceo his dad was “a white b—h trying to rob a black woman,” then asked Maceo, “How do you feel about that as a black man?” and threatened to have Martinez deported to France. Those are Martinez’s allegations, not findings in the temporary order.
Berry’s attorney, Marina Beck, responded: “To say this filing is entirely meritless and deliberately misleading would be an understatement.” Beck said prior rulings found Martinez violated court orders and interfered with Maceo’s therapy and schooling, and that he has been sanctioned. Martinez’s lawyer, Patrick Baghdaserians, said the filing is about the child’s safety and about Berry getting “the appropriate help.”
