Combs’ new attorneys, Jason Driscoll and Alexandra Shapiro, filed a motion for bail to the Southern District Court of New York on Tuesday regarding the judge’s previous denial of his release. This third appeal insists the court rejected a “plainly sufficient” bail package that would have “prevented any conceivable risk of flight or danger.”

“He traveled to New York to surrender because he knew he was going to be indicted. He took extraordinary steps to demonstrate that he intended to face and contest the charges, not flee. He presented a bail package that would plainly stop him from posing a danger to anyone or contacting any witnesses,” the filing reads.

Attorney Marc Agnifilo previously suggested a package with special bond conditions for the rapper such as allowing Combs to be on house arrest in his Miami residence as well as offering $50 million bond — roughly, the value of a property he just paid off, per court documents. Prosecutors argued Combs was “too dangerous” to be released because he could threaten potential witnesses.

“He has already tried to obstruct the Government’s investigation of this case, repeatedly contacting victims and witnesses and feeding them false narratives of events, as described in detail below. There are simply no conditions that would ensure that the defendant’s efforts to obstruct and tamper with witnesses will stop,” the government’s filing read in part.

U.S. District Judge Andrew L. Carter initially sided with the Feds and denied the request ruling the plan was “insufficient” in ensuring he safety of the community. Combs’ attorney, Marc Agnifilo, filed another request the same day of the judge’s ruling... which was also denied.

Will he make it out? A source tells PEOPLE the mogul has enough power to make anyone do what he wants.

“He’s so powerful. Everyone was afraid to cross him. Even though he’s behind bars now, he’s still so powerful. We all knew it even back then,” the source said.

Let’s see if this “power” works on the Feds. In the meantime, Combs is confined to the Metropolitan Detention Center in Brooklyn.

The Scathing Indictment

On Monday, Sept. 16, the 54-year-old rap mogul was arrested in Manhattan by federal authorities. His indictment was unsealed the following morning, revealing charges of racketeering conspiracy, sex trafficking and engaging in interstate transportation for prostitution. The allegations against Combs include sexual abuse, physical abuse, bribery and various drug offenses.

The most notable claims stem from his so-called “freak off” sex parties, where prosecutors allege women and men were drugged and forced to perform sexual acts at Combs’ pleasure. He was also accused of using video footage to blackmail the victims into compliance.

Combs’ arrest was roughly six months after federal authorities raided his two homes in Los Angeles and Miami in March 2024, and four months after damning video footage leaked of him brutally assaulting ex-girlfriend and Bad Boy signee Cassandra “Cassie” Ventura at a hotel in 2016.

In November 2023, Combs was sued by Ventura in a civil suit that accused him of sex trafficking, human trafficking, sexual battery, sexual assault, and other allegations. Combs quickly settled the suit within 24 hours, but nearly a dozen lawsuits from other associates have quickly followed in the months since.

While many of the suits since 2023 have been civil, this federal case has Combs facing criminal charges. He has pleaded not guilty and due back in court on Oct. 9.
