Indonesian in Miri jailed five months for overstaying, to be deported upon release
by Jenifer Laeng · Borneo Post OnlineMIRI (Nov 18): A 24-year-old Indonesian man was sentenced to five months in jail by the Sessions Court here today for overstaying in the country.
Judge Azreena Aziz meted out the sentence against Dendy Hamidi from Sambas after he pleaded guilty to a charge under Section 15(1)(c) of the Immigration Act 1959/63, punishable under Section 15(4) of the same Act.
The Section provides for a fine of up to RM10,000, or imprisonment for up to five years, or both, upon conviction.
The court ordered for the prison term to run from the date of arrest on Nov 8 and for Dendy to be referred to the Immigration Department for deportation upon his release.
According to the facts of the case, Dendy was detained at a longhouse near Teru Bridge in Tinjar, Baram for having an expired social visit pass.
Deputy public prosecutor Jonathan Lim prosecuted the case, while the accused was unrepresented by legal counsel.
