Politician’s application to review order dismissed

KOTA KINABALU (Sept 24): A High Court here on Tuesday dismissed an application by a politician to review an order made against him to enter his defence on four charges of molesting an Unduk Ngadau contestant.

Justice Datuk Ismail Brahim dismissed Phillip Among’s application after hearing submissions from both parties in this revision.

Philip, 55, had applied to review a Magistrate’s Court’s decision to order him to enter his defence on the said charges.

In December 2023, the said lower court had ordered Philip to enter his defence after the court ruled that the prosecution had established a prima facie case against him.

His four other cases stated that he allegedly molested the beauty pageant contestant at four different locations namely at a studio of a company at Asia City, inside a moving car on the way from dinner to an old office, at a staircase beside a photo studio here and inside an office at Metrotown respectively. All the alleged molest incidents happened on May 19, 2021.
If found guilty, the respondent is liable to a jail term of up to 10 years and a fine or with whipping or any two of the punishments, upon conviction.
