Duo acquitted of trafficking meth at Kuching bus terminal in 2022

KUCHING (April 9): The High Court here discharged and acquitted two men of trafficking 717.5 grammes of methamphetamine at a bus terminal at Jalan Penrissen here nearly four years ago.

Judge Datuk Faridz Gohim Abdullah ruled that the prosecution had failed to establish a prima facie case against Ho Chee Leong, 33, and Low Ching Soon, 36.

The court found conflicting evidence and loopholes in the prosecution’s case.

After evaluating the evidence in its entirety, the court held that the charge was not proven and accordingly discharged and acquitted both accused.

Ho and Low were charged under Section 39B(1)(a) of the Dangerous Drugs Act 1952, punishable under Section 39B(2) of the same Act, which carries the death penalty or life imprisonment and a minimum 15 strokes of the cane upon conviction.

They were accused of committing the offence at the Mile 6 bus terminal, Jalan Penrissen at around 1.50pm on July 14, 2022.

Deputy public prosecutor Nur Anida Mohd Nasir appeared for the prosecution.

Ho was represented by counsel Louis Jarau, while Low was represented by Patrick Voon, Alex Kong, Tiong Ing Neng, and pupil in chambers Amarprit Singh.
