Kim Zolciak's Son Is '100% Innocent', KJ's Lawyer Cites Polygraph, DNA Findings In Sex Battery Case

Kim Zolciak and Kroy Biermann's 15-year-old son, Kroy “KJ” Biermann, is facing serious criminal allegations in Georgia, but his attorney is firmly denying the claims and insisting that the teenager is innocent. The teen was arrested on August 17, 2026, after allegations of his involvement in sodomy and sexual battery inside a gym changing area. 

KJ Biermann’s lawyer cites polygraph test to prove his innocence

Attorney Jason Sheffield spoke out after KJ was arrested on charges of aggravated sodomy and aggravated sexual battery. In a statement shared with USA TODAY on August 21, 2026, Sheffield vouched for the teen's innocence, stressing that both the accused and the alleged victim are minors and questioned why details of the case had become public. He then strongly defended KJ, saying he is "100 percent innocent." Sheffield said:

"First and foremost, this is not the kind of information that should be for public dissemination. These are juveniles. Secondly, my client is 100% innocent and tried to present evidence to the arresting officer."

The lawyer states that KJ had already taken a voluntary polygraph test to prove his innocence after "prior false allegations by the alleged victim." He had apparently tried to present the specialist-signed report to the arresting officer.

Sheffield also cited the police report notes, saying that investigators found no male DNA on or inside the areas identified by the alleged victim during the sexual assault examination. KJ's lawyer previously told Page Six that the fact that the 15-year-old was being held without a bond "is a tragedy."

What does the police report allege?

According to the police report, the alleged victim told authorities that she encountered KJ at the gym and eventually entered the family locker-room area with him, where he assaulted her. 

As per the police report, the girl said that KJ allegedly sexually assaulted her despite her telling him no multiple times. She claimed that she only managed to get away from him when he "pulled up his pants and left." After the alleged assault, she did not tell anyone about it until she went to school the next day and ran into KJ’s girlfriend. She later disclosed the alleged incident to her grandmother and was taken to a hospital, where she underwent a sexual assault examination. 

Investigators reportedly reviewed surveillance footage later, which allegedly showed KJ entering the family locker room with the girl. Police said they remained inside for roughly 30 minutes before separating. The report also states that the sexual assault examination found no evidence of male DNA in the alleged victim's mouth or genital area.

However, the absence of DNA does not by itself establish whether an assault had occurred, and the allegations remain unproven at this stage. Amid the public backlash, KJ's mother, Kim Zolciak, has publicly voiced her support.

Following KJ's arrest, the Real Housewives of Atlanta alum called the allegations “nothing short of reckless and deeply troubling” and said her son categorically denies the claims. Zolciak also cited the polygraph examination and the reported lack of DNA belonging to KJ, and asked people not to reach conclusions before the legal process plays out. 

Kim Zolciak noted how such "false accusations" could bear devastating consequences for the one who is being accused and those who are "genuine survivors of sexual assault and abuse." The reality TV star told Page Six:

"Every legitimate allegation deserves to be taken seriously and investigated based on the facts and evidence. At the same time, no one should be publicly condemned based solely on an accusation. We remain confident that the facts and evidence will establish the truth, and we ask that people allow the proper process to take its course rather than spreading unproven allegations."

KJ is the eldest son of Zolciak and former NFL player Kroy Biermann, who married in 2011 and filed for divorce in 2023 after years of togetherness. The former couple also shares son Kash and twins Kaia and Kane. Kroy also adopted Zolciak's daughters Brielle and Ariana from a previous relationship.

KJ was arrested without bond and remains in custody at the Metro Regional Youth Detention Center. His preliminary hearing is scheduled for September 8, 2026.
