Jeffrey: Concerning rise in statutory declarations to support non-citizen identification documents

KOTA KINABALU (Nov 1): The increasing number of statutory declarations (SD) supporting identification documents for non-citizens in Sabah is concerning, said Datuk Seri Panglima Dr Jeffrey Kitingan.

The Deputy Chief Minister I noted that there has been a surge in these SDs signed by non-citizens here, specifically aimed at supporting applications for identification documents.

He said the contents of these SDs show that non-citizens are declaring their residence in Sabah and affirming their lawful conduct, presumably to facilitate their documentation processes.

“This trend raises significant concerns, particularly with the certification of these declarations by commissioners for oaths. Such endorsements could lead to unintended legal consequences.

“The timing and frequency of these SDs necessitate heightened scrutiny. There is a real risk that these documents could be misused, potentially impacting Sabah’s legal and electoral integrity,” he pointed out in a statement today.

“As the Deputy Chief Minister and president of STAR Sabah, I am issuing a firm reminder and a stern warning to all commissioners for oaths, magistrates, and relevant authorities to exercise the utmost caution when handling such declarations.”

He pointed out the role of commissioners for oaths is to uphold the integrity of the legal system.

They must ensure that no actions taken inadvertently support the issuance of identification documents to non-citizens through irregular means, he said.

“Every statutory declaration linked to identification or citizenship applications must undergo rigorous assessment and officials must remain vigilant to prevent any misuse of the SD process,” he added.

Jeffrey also stressed that Sabah’s sovereignty, the integrity of its electoral system, and the rights of genuine citizens are paramount, and they must be protected against any form of manipulation or misuse of legal processes.

“As Sabahans, we must ensure that the actions of our legal representatives reflect our dedication to transparency and adherence to established laws.

“I call upon all relevant authorities to closely monitor these developments, verify the legitimacy of each declaration, and uphold Sabah’s legal and democratic foundations,” he added.
