Trans row tribunal judge faces backlash as ruling misnamed campaigners
by Dan Barker · Mail OnlineThe troubled Sandie Peggie tribunal ruling is facing having to issue yet another correction after a campaign group was misnamed in a way which it claimed harmed its reputation.
Not All Gays, a gender critical campaign group which intervened in the high-profile tribunal, demanded a correction after it was named as ‘Not for Gays’ in the ruling.
The group said it was not only a ‘deeply troubling typographical error’ but also placed a ‘negative inference’ on the organisation as one which does NOT support gay rights.
Yesterday Not All Gays submitted a Rule 67 request to the tribunal, which is a way of correcting clerical mistakes.
While the first mention on the tribunal refers to the group correctly as Not All Gays, in paragraph 21, it is referred to as ‘Not for Gays’ in paragraph 1,264.
A group spokesman said: ‘Not only is this a deeply troubling typographical error, but it also places a negative inference on Not All Gays as an organisation, implying or mispresenting that we do not support gay rights.
‘To have this negative implication placed on us and recorded in an employment tribunal judgement, which is so heavily covered by the mainstream media, both in the UK and abroad, is simply unacceptable.
'It is, in our opinion, entirely unacceptable to name us as “Not for Gays”, without correction, due to the implications this will have [to] our good standing and reputation, particularly in the unusually high coverage this case has, and continues to have in all forms of media.’
Since the tribunal found NHS Fife had harassed Mrs Peggie but dropped the other claims she brought against the health board and dismissed all against transgender medic Dr Beth Upton – it has come under fire from lawyers and campaigners alike.

Sandie Peggie judgment revised after initial decision 'used incorrect quote' from previous case
On Thursday it was forced to correct a mistake which saw it use a quote which did not exist.
Judge Sandy Kemp issued the correction, replacing an erroneous quote from the Maya Forstater case which enshrined legal protection to gender critical belief with the correct quote from the landmark tribunal.
Yesterday’s correction demand from Not All Gays casts even more doubt over the ruling, one which the 52-year-old nurse vowed she would appeal during an emotional press conference.
Mrs Peggie was suspended from work at Victoria Hospital, Kirkcaldy, after challenging the presence of Dr Upton, a biological male, in the woman’s changing room on Christmas Eve 2023.
But the ruling said Dr Upton was legally allowed to use the facility up until the point when the nurse first complained earlier that year, at which point the medic should have been temporarily stopped until they were on different shift patterns.
Mrs Peggie said: ‘Whilst I am delighted that the tribunal was critical of Fife Health Board and found they harassed me, their judgment I believe falls short in many respects and that is why I certainly won’t be giving up this legal fight any time soon.’
