Supreme Court Calls for Banks to Compensate Customers for Losses Due to Security Lapses in Digital Fraud Cases

New Delhi: The Supreme Court has stressed that banks must be held accountable for financial losses suffered by customers due to security lapses and negligence in preventing cyber fraud and digital arrest scams.
A bench headed by Justice Surya Kant observed that banks are not merely commercial establishments but also have a responsibility to safeguard their customers’ hard-earned savings.
The court expressed concern that banks often blame customers for negligence after fraudulent transactions instead of addressing shortcomings in their own security systems.
It observed that unless banks face stringent legal consequences, including compensation liabilities for their own failures, they may lack sufficient incentive to improve operational and cybersecurity measures.
The bench also questioned why banks were not making adequate use of artificial intelligence and automated systems to detect and prevent suspicious transactions.
The court observed that merely advising fraud victims to lodge an FIR or file a cybercrime complaint after losing their money was insufficient.

Instead, banks should adopt proactive measures to identify suspicious transactions, temporarily freeze such transactions and immediately alert the nearest police station or cybercrime cell.
The Supreme Court also raised concerns over mule accounts frequently used by cybercriminals to transfer fraudulently obtained money. It questioned whether inadequate Know Your Customer (KYC) verification procedures were contributing to the proliferation of such accounts.
The apex court is continuing to monitor cases involving digital fraud and cybersecurity failures.
The Reserve Bank of India’s revised KYC guidelines for 2026 are expected to come under scrutiny during a subsequent hearing, with December 31 mentioned as a deadline for nationwide implementation.
