Texas, US Gun And Marijuana Law Changes

When it comes to pot and guns, both Texas state and federal laws may be changing. It's good news for many but 1 proposed change could be bad news for some.

Any Texan legally able to own a firearm can apply for a concealed carry license but a proposed new law being considered by Texas would require all applicants to prove their citizenship.

I always thought you had to be a citizen to, (legally) own a gun in the first place but, apparently, non-citizens can buy firearms. Forget that CCL license though if this law passes.

Foreigners Can Own Firearms?

If they're here legally, yes - someone from a foreign country can own a gun. If they're not here legally they're in trouble.

For undocumented immigrants, possession of a firearm is both a state and federal offense. Visa holders, including students, tourists, and workers, cannot possess firearms unless they meet specific exemptions. - mezalawfirm.com

Permanent residents are ok though. This new law would also apply to people trying to become security guards, private investigators, medical marijuana applicants and a bunch more licenses issued by the Texas DPS.

Marijuana Users Can't Have Guns

This is a kinda sneaky little law that makes zillions of legal gun owners criminals. Every gun purchase via an FFL licensed dealer requires the buyer to fill out form 4473. There are a ton of questions on this thing and one of them asks if the buyer smokes pot. If the answer is yes, the purchase is denied.

Now that pot has been reclassified though, a new proposal, (if it passes), would amend the rule and make it legal for medical marijuana card holders to legally purchase firearms.  If you're not a card holder though, you're still out of luck.

Even if the revision is finalized as proposed, a person who uses marijuana recreationally in a state where it is legal but who is not a registered medical patient remains in the same position as before—barred from purchasing a firearm under federal law. - marijuanamoment.net
