Dutch gov't takes over regulation of real estate agents after consistent complaints

With some reluctance, Housing Minister Elanor Boekholt-O’Sullivan (D66) is stepping in to regulate real estate agents. Self-regulation has proved insufficient to prevent abuses like preferential treatment and driving up prices by playing buyers off against each other, as consistent complaints to the homeowners’ association VEH have shown. The government will implement a mandatory register for realtors, oblige realtors to disclose the bidding log recording all bids, and establish a committee to resolve disputes, NOS reported.

Following reports from the VEH, the Minister commissioned a study into the functioning of realtors. Nearly a third of respondents reported having at least one negative experience with a real estate agent, usually the selling agent. Almost 90 percent of these complaints involved agents affiliated with a trade association. Only two percent of people who had a negative experience filed an official complaint.

The Minister had hoped that the professional associations in the sector would be able to reach their own agreements regarding quality and fairness. But discussions with various real estate organizations showed that codes of conduct and improvement plans proved insufficient to effectively deal wth unscrupulous agents. The government has therefore decided to step in. “This is a major step, so I would have preferred not to take it,” Boekholt-O’Sullivan said.

The government will implement a register for real estate agents. All realtors will have to register with the government system in order to practice their profession. “By doing so, you commit to specific rules: working transparently, acting honestly, and disclosing the bidding log,” the Minister said. “Sometimes, people are advised by their agent to bid €10,000 more, but they have no idea whether there is actually a competing bid from someone else.”

The government will also establish a dispute resolution committee for clients who encounter issues with realtors. Depending on the severity or volume of complaints, this committee can reprimand a realtor, including removal from the register in extreme cases.

The Minister promised to present a concrete legislative proposal to anchor these measures in law by early next year.
